Manila, Philippines - The Federation of School Sports Association of the Philippines (FESSAP) is ready to take its battle against Kenny Chow and Seetow Cheng Fave of the Asian University Sports Federation (AUSF) to the courts  for arbitrarily withdrawing recognition of the long-time member FESSAP in the AUSF in October last year without any due cause and simply giving it to the University Athletic Association of the Philippines (UAAP), an association composed of only six schools from the Metro Manila area, on their own say-so. In a press conference held at the National Press Club, FESSAP lawyers Leo Luis P. Mendoza and Ma. Luz S. Arzaga-Mendoza from the Mendoza Arzaga-Mendoza Law Firm read out a letter that decried the actions of Chow and Seetow, who "have been interfering with the sole members of FESSAP in the AUSF by entertaining the application of another group, although merely an athletic association limited to Metro Manila and much smaller than FESSAP."

The Mendozas also said floating the idea of "two participants" from the Philippines is unacceptable.

"Your act/s of interfering with the enjoinment of the rights of FESSAP as the sole recognized member of AUSF is an actionable wrong," the letter said.  "We now ask you to cease and desist from said act/s immediately or we will file disciplinary action/s against both of you in the proper arbitration board or any other body or tribunal, including criminal conspiracy and civil action for damages.

The FESSAP has been a regular member of the AUSF since 2000 but political patronage got in the way in October 2012 in Thailand where Chow and Seetow instigated the FESSAP's ouster through connivance with a disgruntled league composed of only of six Metro Manila schools.  The issue was not even listed in the agenda of the AUSF meeting and the issuance of an invitation to the meeting was, in fact, extended to the representative of the FESSAP.

The FESSAP lawyers said Chow and Seetow have dealt with its client with "prejudice and in a manner that violates the fundamental rules of fair play."

According to the Mendozas, additional court cases will be in the offing if the two AUSF officials even attempt to bring the issue before the International University Sports Federation (FISU), of which the FESSAP has been a regular member since 2009 and enjoys voting rights.  The FESSAP is the sole university sports federation recognized by the FISU, which organizes the Summer and Winter Universiades.

The AUSF is only an associate member of the FISU.

The FESSAP is sending a delegation to the 27th Summer Universiade in Kazan, Russian Federation from July 6-17 this year.  It will take part in 11 sports. Two years ago, in Shenzhen, China, the FESSAP also participated in the Universiade.

Dear AUSF Members:

We have written the AUSF officials about the spreading of the false information on the membership status of  FESSAP.

Such misrepresentation is geared towards maligning the image of FESSAP, and as such we have issued a stern forwarning, such malicious act will be dealt.

Please see attached communications.

Thank you.
